PUBLIC CONTRACT (offer)

on the provision of services for the processing of visa documents

Limited Liability Company "TC" Center for Amazing Journeys "(hereinafter - the Contractor), represented by Oksana Stepanivna Grishchenko, acting on the basis of the Charter, guided by Art. 633, 634 of the Civil Code of Ukraine, offers an unlimited number of persons to receive services for the reception of applications (questionnaires) for obtaining visa reference codes and the documents attached thereto for subsequent transfer to the Ministry of Foreign Affairs of Iran for the purpose of processing and issuing a visa reference code, with the provisions of this Public Contract (hereinafter referred to as the "Agreement").

1. Definition of terms

1.1 The Public Contract (offer) is a transaction, regulates the relationship between the Customer and the Contractor for the provision of services for the receipt of applications (questionnaires) for obtaining visa reference codes and the documents attached thereto for further transfer to the Iranian Ministry of Foreign Affairs (the Iranian Embassy), for the purpose processing and registration of the visa reference code on terms determined by the Contractor.

1.2 The moment of conclusion of the contract - the moment when the Customer submits an application (questionnaire) to the Contractor for receiving the visa reference code and / or payment for the Contractor's services.

1.3 The site is an information resource placed by the Contractor on the Internet at: https://www.mysteryofiran.com, through which information about the basic requirements for issuing exit / entry documents and the rules for entry into the country of temporary stay is provided; conditions of stay in the country of temporary stay and so on.

1.4. Executor - Travel company "Center for Amazing Travel" lawfully publishes the prices and terms of providing tourist services on the website.

1.5 The customer is a natural person who has accepted the acceptance, that is, accepted the proposal for the conclusion of this Agreement, as a result of which the Agreement is concluded between this person and the Contractor.

1.6 Acceptance of the offer - full and unconditional acceptance of the terms of the offer by the Customer's actions, expressing the intention to use the Contractor's website for processing his services.

1.7 Visa reference code - visa permission (7th reference code) issued by the Ministry of Foreign Affairs of Iran for visa processing.

1.8 Iran's Ministry of Foreign Affairs - Iran's Ministry of Foreign Affairs.

2. Subject matter of the agreement

2.1. Under this Agreement, the Customer instructs, and the Contractor assumes obligations on behalf of, on behalf of and at the expense of the Customer, to ensure the transfer of the application (questionnaire) and the documents attached to it to the Ministry of Foreign Affairs of Iran to obtain a visa reference code followed by the receipt of a visa.

2.2. The Contractor facilitates the preparation and sending in electronic form of the application (questionnaire) and the documents attached to it on behalf and on behalf of the Customer on the basis of the documents and information provided by the Customer: preparation of the package of documents (completeness of the questionnaire, proper photo, scan copies of the passport and etc.), the transfer of documents to the Ministry of Foreign Affairs of Iran, receipt and sending to the Customer by e-mail a letter - a decision granting him a visa reference code.

2.3 This public contract-offer is considered concluded (acceptance of the offer) from the moment of confirmation by the Customer of its consent with its terms and conditions by clicking the button of the service selected by it, filling out the form and stating the "I agree with the terms of the public contract-offer" after which the public contract-offer is considered the basic document in the official relationship between the Customer and the Contractor.

2.4 The subject of this agreement is not the provision of a visa for the Customer. To this end, the Customer, depending on the chosen method of obtaining a visa in the application (questionnaire) independently submits the necessary documents along with the visa reference code to the embassy / consulate of Iran or at the airport upon arrival.

3. Rights and obligations of the Parties

3.1 The Contractor, in order to fulfill the terms of this Agreement, undertakes:

3.1.1. Inform the Customer about the rules for issuing visas and visa reference codes, a list of the required documents and requirements of the Iranian Ministry of Foreign Affairs to the applicants and documents submitted by them;

3.1.2. Organize a timely submission of an application (questionnaire) and relevant documents received from the Customer in electronic form to the Iranian Ministry of Foreign Affairs.

3.1.3. Immediately inform the Customer about the emergence of extraordinary circumstances that prevent the provision of certain services or the departure of the Customer's border.

3.2 The Contractor has the right:

- refuse to provide services in the event of a violation by the Customer of the terms of the Contract, failure by the Customer to provide essential information necessary for issuing a visa reference code, non-payment of the Contractor's services. The submission of the specified information (photo, scan copies of the passport, etc.) in an improper form, or violation of other obligations established by this Agreement will be considered by the Contractor as a rejection of the contract at the initiative of the Customer;

- involve third parties in order to provide services to the Customer;
- require the Customer to comply with the terms of this Agreement and timely payment for the services rendered;

3.3. The obligation to provide services arises from the Contractor from the date of payment by the Customer of these services.

3.4. The obligations of the Contractor under this Agreement shall be deemed to be duly executed from the moment of sending the letter to the Customer to the e-mail address. - The decision of the Iranian Ministry of Foreign Affairs on the application (questionnaire) for obtaining the visa reference code, irrespective of the result of such consideration.
3.5. The Customer undertakes:

3.5.1 Provide to the Contractor in electronic form reliable and sufficient information and valid documents for the provision of services by the Contractor.

3.5.2. In time and in full, pay for the services ordered in accordance with the terms of this Agreement.

3.5.3 Refusal to provide or provide an incomplete list of documents can be considered as termination of the contract at the initiative of the Customer. The customer is fully responsible for the accuracy of the information provided to them;

 3.5.4 Provide the Contractor with accurate and reliable information about its mailing address, the phone's e-mail address, as well as other information required by the Contractor for prompt communication with the Customer.

3.6. The customer has the right:

3.6.1 To receive information on the procedure for providing services, the list of documents required to obtain a visa reference code, the cost of the Contractor's services, the time period for considering an application for obtaining a visa reference code of the Iranian Foreign Ministry, and other information regarding obtaining a visa and visa reference code.

4. Procedure for the provision of services

4.1. After acquaintance with the information about the terms of services provided on the website, the Customer is free to choose any services posted by the Contractor on the website at the price determined on the website during the term of the offer with the help of the on-line system access, posted on the website.

4.2. The application for obtaining the visa reference code (questionnaire) is submitted by the Customer on the Contractor's website at the link https://www.mysteryofiran.com by filling in and sending the established form of the selected service. After confirming the order, sending the application for obtaining the visa reference code (questionnaire) and the documents attached to it by clicking the "Send" button, the system will automatically send the Customer to the payment page. The customer pays the invoice for payment of services by bank transfer to the settlement account of the Contractor by payment with the help of a bank card or in cash at the bank's checkout.

4.3. The customer is obliged to apply for a visa reference code by completing the form and attaching the necessary documents (depending on the type of visa) to him personally, excluding filing of applications:

 - parents of under-age children under the age of 18;
 - by persons who are business partners and colleagues on the job, provided that a properly issued document is provided on a letterhead of an enterprise whose content provides for the authorization of an employee of that enterprise to submit applications for obtaining a visa reference code
 - travel companies and agencies.

4.4 The Customer pays the cost of the Contractor's services, the amount of which depends on the type of visa required, the time for consideration of the application, the full information about which is posted on the RU-NIC's official website.

4.4.1 Payment of expenses for banking operations is carried out at the expense of the Customer.

4.4.2 Confirmation of the order of the selected services is carried out by pressing the button "Pay" and after crediting the funds to the account of the Contractor.

4.5 The Contractor shall not be liable for late transfer of funds to the Executor's settlement account. The Contractor reserves the right to cancel the services offered and / or deny service for the selected services until the Customer has confirmed the confirmed order.

4.6. After payment of the Contractor's services, the Customer is obliged to electronically provide the Contractor with the original payment document confirming payment in the event that the payment for services was made through the establishment of the bank or by non-cash settlement.

4.7. After the submission to the Contractor, the application for obtaining the visa application form (questionnaire) with the documents attached to it, the payment document, the performer checks the completeness of the questionnaire filling and the correspondence (belonging) of the photo and scan copies of the passport to the established sample. After verification, the application with attached documents in electronic form is transferred by the Contractor to the Ministry of Foreign Affairs of Iran for further processing and decision-making on providing the Customer with visa reference code.

4.8. The processing time of the application for visa application forms (questionnaire) with the documents attached to it by the Ministry of Foreign Affairs of Iran and the decision to provide a visa reference code to the Customer is 4-10 working days.

4.9. During consideration of the submitted application for the provision of a visa reference code (questionnaire), the Iranian Ministry of Foreign Affairs has the right to request from the applicant additional documents necessary for making a decision on issuing a visa document. After receiving instructions from the Iranian Ministry of Foreign Affairs about the request for additional documents, the Contractor as soon as possible informs the Customer about the need to provide the requested documents to the specified Iranian Ministry of Foreign Affairs and carries out an electronic receipt via e-mail of their receipt from the Customer and transfer to the Iranian Ministry of Foreign Affairs.

4.9.1 If the Customer does not provide the documents requested by the Iranian Ministry of Foreign Affairs, or allows the deadline set for the fulfillment of the request, or performs other actions that will be identical to the evasion of the provision of additional documents, the Customer bears responsibility for the consequences of such actions.

4.10. In the event that the Contractor will not be able to contact the Customer due to the fact that the means of communication indicated by the Customer when submitting the application for issuing the visa reference code (questionnaire) are incorrect or irrelevant, the responsibility for such consequences is entirely the responsibility of the Customer.

4.11. Based on the results of the consideration of the application for the issuance of a visa reference code (questionnaire) of the Ministry of Foreign Affairs of Iran, a decision is taken to issue a visa reference code or refuse to issue it. After the decision is taken, the Customer's visa reference code is electronically transmitted to the Iranian Ministry of Foreign Affairs for further transfer to the Customer. In case of refusal to issue a visa reference code, the Customer is sent an e-mail about the refusal with a 7-digit code.

4.12. The Customer can receive information on completion of the procedure for considering the application submitted and obtaining the visa reference code or refusal to issue a visa reference code of the Iranian Ministry of Foreign Affairs on the official website at the following link: https://evisatraveller.mfa.ir/en/request/status/ by introducing code.

5. Information and consulting services

5.1. Information and consulting services in respect of the product ordered by the Customer as a result of the conclusion of this Agreement or the order of which the Customer plans to make, provided by the Contractor.
Information and consulting services include:

- Consultation of the Customer by the Site Support Service on issues related to tourism products, services and use of the Site;
- advising on insurance for travel;
- Visa support - additional services;
- advising on hotel booking;
- Other services.

5.2. When placing an Order on the Site, the Customer can order additional services by marking the need for an additional service in the Application. You can also order additional services by contacting the Customer Support Service. The cost of additional services is paid by the Customer separately on the basis of an additional invoice issued by the Contractor and sent to the Customer with the corresponding message by e-mail.

6. Cost of services and settlement procedure

6.1. The cost of the Contractor's services for receiving an application for a visa reference code (questionnaire) and the documents attached to it depends on the type of visa received, the period for consideration of the application by the Ministry of Foreign Affairs of Iran and other conditions that are posted on the official website of the Contractor.

6.2. The Contractor can provide the Customer with additional services related to the processing of visa documents, the list and cost of which are posted on the official website of the Contractor.

6.3. Payment for the Contractor's services can be carried out by the Customer by transferring a bank transfer to the Executor's settlement account on the basis of the issued invoice / invoice, or by a bank card on the Contractor's website, or by cashless transfer of funds on the basis of this contract.

7. RESPONSIBILITY OF THE PARTIES

7.1. The executor warns that the Iranian Ministry of Foreign Affairs, as is customary in international practice, may refuse to issue a visa reference code (entry permit) or detain it without explaining the reasons. In this connection, the Executor does not bear any financial or legal responsibility for the actions of the Iranian Ministry of Foreign Affairs. In case of refusal or delay in issuing a visa reference code, the Contractor retains the full cost of the services.

7.2. The Contractor is not responsible for the travel documents previously purchased by the Customer and the planned activities (negotiations, signing of contracts, etc.) that did not take place due to refusal or delay in issuing a visa.

7.3. If the Ministry of Foreign Affairs of Iran requires the provision of additional information or documents by the Customer, the Contractor is obliged to inform the Customer in time, and the latter, in turn, must provide additional information in a timely manner.

7.4. In the event of the CUSTOMER's refusal of the Contractor's services before the expiration of the period necessary for issuing the visa reference code, the full cost of the services is contained with the CUSTOMER.

7.5. The Contractor shall not be liable if a permit for a single entry or a shorter period of stay is granted upon issuing a multiple entry visa.

8. Circumstances of force majeure (force majeure)

8.1. According to this Agreement, the Parties are responsible for non-fulfillment (improper performance) of their duties, if such failure (improper performance) occurred as a result of force majeure circumstances.

8.2. The circumstances of the force majeure (force majeure) under the Treaty are spontaneous natural phenomena (floods, earthquakes, snowstorms and other natural disasters), disasters of biological, man-made and anthropogenic origin (explosions, fires, mass epidemics, epizootics, epiphytotics, etc.). ), the circumstances of public life (war or military actions, blockades, social unrest, manifestations of terrorism, mass strikes, etc.), actions or regulatory requirements of public authorities and other circumstances outside the control and will of the parties took place after the entry into force of the Treaty, directly affect the actions of the Parties and make it impossible to fulfill obligations under this Treaty.

9. Duration of the Agreement

 9.1. Terms of the Agreement are publicly disclosed to all Customers by posting it on the Site.

9.2. The contract comes into force from the moment of its conclusion (acceptance of the offer), namely from the moment the Customer submits an application for obtaining a visa reference code (questionnaire) and / or payment for the Contractor's services, and remains in effect until the Parties fulfill their obligations under the Agreement.

10. Settlement of disputes

10.1. All disputes and disagreements arising in the performance of the Treaty shall be resolved by the Parties through negotiations and by way of pre-trial settlement of the dispute.

10.2. If it is not possible to resolve the dispute through negotiation and in the manner of pre-trial settlement of the dispute, disputes between the Parties shall be resolved by judicial procedure in accordance with the current legislation of Ukraine.

11. Regulation on personal data

11.1. By concluding this Agreement, the Customer confirms that he is fully acquainted with and agrees with his terms and conditions, and authorizes the Contractor to process his personal data in order to be able to fulfill the terms of this offer contract, the possibility of mutual settlements, as well as to receive invoices, acts and other documents.

11.2. Permission to process personal data is valid for the entire duration of the contract-offer, as well as for the next five years after the end of its validity.

11.3. The destruction of personal data is the basis for termination of the contract-offer and is carried out on the basis of written (in electronic form) applications of the Customer. In this case, the contract-offer is broken from the date specified in the Customer's relevant message.

11.4. In addition, by concluding this offer contract, the Customer confirms that he has been notified (without additional notice) of the rights established by the Law of Ukraine "On Protection of Personal Data" about the purposes of data collection, and that his personal data is transferred to the Tourist Company "Center of Amazing Journeys" in order to be able to fulfill the conditions of this contract-offer, the possibility of mutual settlements, as well as to receive invoices, acts and other documents.

11.5. The Customer also agrees that the Executor has the right to grant access and transfer his personal data to third parties without any additional notifications of the Customer, without changing the purpose of processing personal data. The scope of the rights of the Customer as a subject of personal data in accordance with the Law of Ukraine "On Protection of Personal Data" is known to the Customer and is understandable.
